The privacy of our customers is important to us. This Privacy Policy intends to inform YOU about the use by BLOOD BLAST of the Personal Data (as defined below) BLOOD BLAST can collect about YOU. This Privacy Policy applies in addition to the terms of use or contract, if any, applicable to the services provided to YOU by BLOOD BLAST.

2.1 Why does BLOOD BLAST collect Personal Data?

BLOOD BLAST needs your Personal Data in order to provide Services (for example: pay YOU, distribute your music, answer your questions, keep track of your account, collect fees, provide new opportunities, contact YOU for update purposes, optimize the use of our website, deliver new products and a high-quality user experience).

2.2 What Personal Data does BLOOD BLAST collect?

Personal collected by BLOOD BLAST directly from YOU:

BLOOD BLAST will need basic Personal Data that might, inter alia, consist of all or part of the following:
– Name of the end user or of the account holder;

– Language spoken;
– Technical information as referred to in Section 5 below (cookies, IP address, etc)

– Any personal information that will help remind YOU of your BLOOD BLAST account login and/or password.

BLOOD BLAST may also collect from YOU:
– any other Personal Data as YOU may communicate to BLOOD BLAST from time to time by your own choice.
– non-Personal Data including: names of your songs and albums and the related artists; year that your recordings were made/released; name of the persons or entities that own and control the rights to the songs, albums and/or artwork delivered to BLOOD BLAST. Such information may be used inter alia to keep track of how albums and/or songs are sold for ranking charts.

BLOOD BLAST may also set up a system that allows YOU to purchase and/or send gift certificates or links to any content or Services to other BLOOD BLAST users, family members, friends or contacts. To that end, BLOOD BLAST may require personal information about the recipient, only for the purpose for which it is collected.


Personal collected by BLOOD BLAST from third parties:

BLOOD BLAST may also be provided Personal Data by third parties to whom YOU have communicated Personal Data according to the data privacy policy of such third party YOU have expressly agreed (as for example “Social Media Platforms” such as Twitter, Facebook, SoundCloud, Instagram, MixCloud, etc). Inter alia, BLOOD BLAST may obtain access permissions to end user pages of such third party and data relating to your pages (including but not limited to “access token pages”, “manage pages”, “read insights”, “show pages lists”, “publish pages”, “ID users” and any public information as published on the users pages (including pictures).

If YOU use our Services to connect to third party services (including “Social Media Platforms” as defined above), BLOOD BLAST may also archive certain information about YOU and your activities, including but not limited to: user generated content (messages, posts, comments, pages, profiles, images, feeds or communications through the Social Media Platforms, etc), additional customer profile information (age, gender, employer, profession, geographic location, education information, financial status, habits and preferences, etc).

3. PERSONAL DATA USE

3.1 Use of Personal Data by BLOOD BLAST

Your Personal Data is collected and processed in accordance within this Privacy Policy, on the basis of the terms of use of the Services as amended from time to time and/or the contract entered by and between YOU and BLOOD BLAST (if any).

BLOOD BLAST, as a data controller, processes your Personal Data mainly to:
– manage your BLOOD BLAST account,
– provide YOU and other customers with the Services (including settings of the content delivery to third parties, identifying content, proposing a website or any web tool, etc.),
– maintain, secure and improve its Services and operating system,
– ensure the Service and the use of the Service by YOU comply with the applicable laws.

From time to time BLOOD BLAST might also present YOU a voluntary survey or questionnaire about our current or possible future services or products.

3.2 Does BLOOD BLAST disclose Personal Data to anyone?

BLOOD BLAST takes your privacy very seriously. In order to serve YOU it is possible that people working for BLOOD BLAST might view your Personal Data to make sure We provide the best service, but such access will be on a need-to-know basis only and our people will be required to keep your Personal Data confidential and used only as provided by this Privacy Policy.

By using a BLOOD BLAST Service, YOU agree that BLOOD BLAST shall have the right to provide information related to the sales of your recordings to third parties, to aggregate such information in charts and other comparative informational materials, and to disseminate the same in any manner.

Your Personal Data may be transferred to any company that provides BLOOD BLAST with technical services (including but not limited to host provider) as used to deliver the Services. It is also possible that, with improvements to or addition of Services, it may be to your advantage for BLOOD BLAST to make certain Personal Data available to companies that BLOOD BLAST has a strategic relationship with or that perform work for BLOOD BLAST so that they can provide products and services to YOU on behalf of BLOOD BLAST. These companies may help us process information, extend credit, fulfill customer orders, provide YOU Services, manage and enhance customer data, assess your interest in our Services or conduct customer research or satisfaction surveys. We will provide these companies with only the Personal Data that they require to perform the tasks for which they have been hired to. Without such information being made available, it might be difficult to sell your music, upload your songs and your album artwork, use or access our Services, have products delivered to YOU, receive customer service, provide us feedback to improve our Services.

Your personal information may also be disclosed to third parties if BLOOD BLAST is required to do so by law. Furthermore, if BLOOD BLAST receives notification that a content YOU have posted online using a Service infringes on the rights of a third party, BLOOD BLAST may, in its good faith discretion, disclose your contact information to such third party.

3.3 Where is stored or transferred the Personal Data? 

Your Personal Data is mainly stored in European Union by BLOOD BLAST or its hosting providers. It may also be hosted in other countries, at any time in compliance with this Privacy Policy. Please note that, without affecting the governing law of the terms of use of the Service and/or the contract entered by and between YOU and BLOOD BLAST, the processing of your Personal Data is subject to French law.

Notwithstanding the above, when the law applicable to your Personal Data requires to store it in your own country, it may be stored accordingly.

BLOOD BLAST operates its Service all around the world and its teams are located in many countries to ensure provision of the best Service. Therefore, your Personal Data can be transferred in a country other than your own country and where BLOOD BLAST hires employees or providers that may have access to your Personal Data on a need-to-know basis. Each time your Personal Data is transferred out of European Union, we ensure that your Personal Data is protected in accordance with this Privacy Policy.

3.4 How long does BLOOD BLAST keep your Personal Data?

BLOOD BLAST will keep your Personal Data as long as your BLOOD BLAST account is not closed, provided YOU have not validly requested a deletion under Section 6 below.

Please note that some of your data may remain in our records even after your account is closed (for example to prove use of the Services, to process third parties claim within the applicable statute of limitation, etc.)

4. PROTECTION OF YOUR PERSONAL DATA

BLOOD BLAST will take appropriate administrative, technical, physical measures to safeguard your Personal Data against theft, misuse, unauthorized access, disclosure, alteration. BLOOD BLAST has used and will continue using commercially reasonable efforts to ensure the protection of your Personal Data.

Although there will always be people attempting to steal information, we follow the industry accepted security standards designed to safeguard and prevent unauthorized access to, disclosure of and use of your Personal Data. We use Secure Sockets Layer (“SSL”) encryption for credit card and other bank transactions. Due to this level of security, YOU must use an SSL-enabled browser such as Safari, Netscape Navigator 3.0 (or a later version), or Internet Explorer.

In addition, BLOOD BLAST will restrict employee access to databases containing Personal Data and impose confidentiality requirements upon employees who need to know such information.

YOU will be given discretion to create a username and password that only YOU know to protect access to your BLOOD BLAST account. To further protect your information, YOU should change your password often and only use a browser that supports SSL encryption.


5. TECHNICAL INFORMATION (IP addresses, cookies and others)

As is the case with many websites, the BLOOD BLAST websites and apps (the “BLOOD BLAST Properties”) log your IP address and use standard technology called cookies (or similar technologies which store data on client side), which are small data files that are downloaded onto your computer or device when YOU visit the BLOOD BLAST Properties. Cookies identify your browser to the BLOOD BLAST Properties server whenever YOU interact with them so that We can identify YOU and give YOU access to your user account. We use cookies to improve our Services and the quality of your experience while visiting the BLOOD BLAST Properties. By using the BLOOD BLAST Properties, YOU are confirming your consent to our use of cookies as explained in this Privacy Policy.

YOU have the right to:
– Access, rectify, and delete your Personal Data;

provided that such rectification, deletion and opposition do not prevent BLOOD BLAST from providing a Service.

7. WARRANTY AND DISCLAIMER

7.1. YOU warrant to communicate to BLOOD BLAST only your data and data about third parties YOU are duly authorized to communicate. Likewise, if YOU use a BLOOD BLAST Service from a non- BLOOD BLAST account, YOU warrant that this non- BLOOD BLAST account is your personal account or is an account for which YOU have a permitted access and YOU are authorized to manage and administrate.

7.2. YOU defend and hold harmless BLOOD BLAST against any and all claims or actions arising out of a breach of Section 8.1 above.

7.3. If BLOOD BLAST launches community-based services (such as message boards, blogs, instant messaging, etc.), please note that any information YOU share through one of this service is visible to other users and can be seen, collected and used by others. BLOOD BLAST is not responsible for the personal data YOU choose to submit this way, YOU are solely responsible for any content that YOU post there.

7.4. Sometime BLOOD BLAST might link to other websites. If YOU choose to go to these other websites, please note that such websites may not be affiliated with BLOOD BLAST and not be subject to this Privacy Policy. We encourage YOU to carefully review such websites’ respective privacy policies and ask questions directly to them in this regard.

8. MISCELLANEOUS

8.1. BLOOD BLAST may modify, alter or otherwise update this Privacy Policy from time to time, so We encourage YOU to review this Privacy Policy frequently. We may also attempt to notify YOU of any such changes to our Privacy Policy via email or by placing a notice on our home page but are not required to do so.

8.2. This Privacy Policy is governed by French law. Any dispute shall be subject to the exclusive jurisdiction of Paris Court (in France).
